§ 1 Scope

These terms and conditions regulate the Agreement between visitor, user or buyer (“you”) of our products and Alja Slemenšek (“we”, “us”, “our”), owner of the website “aljaslemensek.com”. If you visit or shop at aljaslemensek.com, you accept these conditions.

§ 2 Placing your order

By placing an order with aljaslemensek.com you are offering to purchase the goods (one or more products) detailed within that order, which we may or may not accept at their sole discretion.

If an order is accepted, we will send you an e-mail to confirm. You will then also receive an email confirming the shipment. The order confirmation email can be seen as a confirmation that we received your offer to buy our products.

Please note that you must be 18 years or older to purchase products from us. By placing an order for products on aljaslemensek.com, you confirm and warrant that you are aged 18 years or older.

§ 3 Product description

On our website we try to be as specific as possible about products and product availability, including, availability of size, colour and type, quantity of stock available and the product description. However, while we try our best to ensure that product information on our website is correct, it is possible that the website may contain typographical errors or inaccuracies. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted an order).

Please note that because the colours of the products you will see on the website depend on your monitor/screen, we cannot guarantee that the display of colour will be accurate and some colours may vary. Product imagery is sometimes displayed in an aesthetic manner (mood shots may be used) and may not necessarily be in conformance with the approved use of such products.

The colours and dimensions of the products portrayed on the site are merely there as a guide. We strive to portray the products as near as we can to the actual colour ways, but we have no control over your personal computer and its settings. Some products incorporate natural materials which may also vary slightly. Therefore colours of products may vary slightly from the colour that is portrayed on the website.

Please also note that the information provided about products on the website is for information purposes only. Please make sure you read all labels, warnings and directions provided with the product before use.

§ 4 Prices

The price of products quoted on the website is in EUR (€) and excludes the legal value added tax (VAT). VAT is not included in our prices for customers outside of the EU. We do not sell to businesses, therefore we do not issue VAT receipts, nor do we refund the VAT.

Prices quoted exclude delivery costs which are added to the total cost of the order during the order process. With the exception of all orders within the EU, all recipients of international shipments from aljaslemensek.com are responsible for any local import duties, customs fees, or taxes that may be charged. As with any international shipment, your local customs office may detain the merchandise and delay its arrival while accessing appropriate duty charges.

Availability information for the products in our shop is listed on each item’s detail page. As we process your order, we will inform you by e-mail if any items you order turn out to be unavailable or their delivery will be delayed due to any reasons.

Despite our best efforts, some products may be listed at an incorrect price due to a typographical error or systems error. We reserve the right to review and change product prices on the aljaslemensek.com website at any time without notice and we reserve the right to refuse or cancel any orders placed for products listed at an incorrect price, whether or not the order(s) has/ve been confirmed and your card/PayPal account charged. If your card/PayPal account has already been charged for such a purchase and your order is cancelled, we will issue a refund to your card/PayPal account (as applicable) in the amount of the incorrect price.

§ 5 Promotions

We are running different sales promotions on aljaslemensek.com website. Promotions normally have an ending date, but we have the right to stop all the promotions at any time without mentioning a reason. Also all promotions end, when we run out of stock with a promoted item. You have no right to claim for offers. That applies in particular for coupon codes and vouchers which we have published online, on social media sites or our newsletters.

Unless otherwise expressly stated in the terms and conditions for a particular promotional code, promotional codes cannot be combined and cannot be used in conjunction with any other offer/discount. If you have more than one promotional code and the codes cannot be combined, it is up to you to use the promotional code that has the biggest benefit to you.

§ 6 Payment

You undertake that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information, supplied by you during or after the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made.

If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed, we will have right to rescind and upon their election to do so, the order will be cancelled.

§ 7 Delivery

We aim to deliver your ordered products by the estimated date set out in the despatch confirmation email, or, if no date is given, at the latest within 30 days of the date of the despatch confirmation email. In the event that your delivery is delayed for any reason within our control, we will do our best to keep you informed of the estimated delivery date. Please note that if the product(s) is / are not delivered within 30 days of the despatch confirmation email, you are entitled to cancel the order and be refunded any amounts paid by you for that order.

Ownership of and risk in the products you have ordered will pass to you from the time they are delivered to you. If you decide to return the product(s) to us for a refund or exchange in accordance with our cancellations, returns & exchanges policy, risk will remain with you until you have posted the returned products to us.

If you’re ordering products to be delivered outside of the EU, they may be subject to taxes, fees, levies or other charges due to local laws or customs rules. Whoever your order is addressed to is responsible for all customs costs associated with the import of the products, and will be required to pay any additional charges for international delivery. These include import duty, formal customs entry, taxes, levies and other charges that apply outside the EU. If you’re ordering products to be delivered to someone else, make sure that they’re aware that they’ll need to cover this before you order.

Unfortunately we have no control over these charges and cannot offer assistance on these processes. We recommend that you check the import charges applicable in any non-EU country before ordering products to be delivered there.

Because you (or the recipient of the products, if different) will be the importer for all international deliveries of the products, it’s your responsibility to check that any products ordered comply with state and federal government import regulations, and that there are no local requirements or restrictions which may affect your goods. Make sure you check this before you order.

If your order gets stuck in customs, you or the recipient will need to contact your local customs office and pay any additional charges or taxes to release the goods. We cannot do this on your behalf.

§ 8 Cancellations & Returns

Please contact a member of our customer services team before returning your order via our contact page who may be able to advise on how to return the products to us. This is absolutely necessary for correct processing of your return.

1. DISSATISFIED WITH THE PRODUCT

If you have had a change of heart you must return the item to us unused and in its original condition within 14 days of your receipt of the product for a refund.

Please contact a member of our customer services team before returning your order via our contact page who will be able to help you return the items.

Unless it is defective, the item must be in unused re-saleable condition with all original packaging and documentation. You will be credited for your full purchase less our initial shipping charge. Additionally, you are responsible for the shipping costs of your return. For expensive items we recommend that you use a secure delivery method which requires a signature on receipt, as this insures the package in case it goes missing.

The product will remain your responsibility until it has been signed for at the returns address. We do not accept responsibility for products lost or damaged in the post.

Exceptions

We regret that we cannot accept returns on the following non-faulty products:
— The product(s) has/have been personalised, made to order or customised in any way.
— The non-faulty product does not arrive at us in a resalable condition. In this case we will not be able to offer you a refund. We will contact you to arrange to send the product back to you and to take payment for the subsequent delivery costs.

2. DAMAGED GOODS

If you’ve been unlucky enough to receive a faulty or damaged item, please contact us stating your order number and the nature of the fault. You have 30 days from the date of delivery to return your order. The damaged item and invoice must accompany the return in order for us to process an exchange. Please also include a note stating the product’s defect.

Parcels or items damaged in transit must be reported to aljaslemensek.com by email within 3 days. If the deadline for reporting parcels damaged during transit is not met we regret that we will not be able to issue a refund or replacement goods.

We will reimburse you for return shipping charges only on items, which contain manufacturer defects. We are not responsible for damages caused by incorrect use, handling, or abuse of the item.

When returning faulty items we may still ask you to return goods yourself. On receipt we will reimburse the costs *incurred. We will refund the postage cost you incur to return the item up to the value of 10 €.
* Please obtain a proof of postage costs so we can reimburse you the full amount.
* We regret that we will not be able to refund excessive postage costs (for example goods being sent by special delivery or by courier when this is not necessary).

We will not confirm that we have received your return. After receipt of your goods we aim to issue refunds within 14 working days. The cost of your products will be refunded to the credit/debit card used to make the purchase. Please note refunds take 5 working days to clear from the point of processing.

Cancellations

If you wish to cancel an order please contact our customer services team via our contact page. If your goods have been despatched before cancellation you will be liable for the costs of returning the unwanted items. This returns policy does not affect your statutory rights.

We strongly recommend that you use a secure or trackable method of postage, i.e. recorded or special delivery, and that you keep hold of your proof of postage. Until we receive your return to our warehouse, the items and their condition remain your responsibility.

Refunds will be credited back via the original method of payment. Please allow up to 28 days for your refund to appear on your bank statement. If for any reason we are unable to issue a refund via the original method of payment, we will contact you to arrange an alternative. Delivery charges are non-refundable.

§ 9 Warranty

Unless specific warranties are expressly given when you purchase products from our site (for example, a manufacturer’s warranty), we do not give any warranties or guarantees in respect of such products over and above those implied by applicable law (these include, for example, that the products are of satisfactory quality and reasonably fit for all the purposes for which products of that kind are commonly supplied). We remain responsible, however, for supplying products that conform to the contract.

§ 10 Our liability

We attempt to ensure that the information available on the web site at any one time is accurate. However, we assume no duty to update such information and cannot guarantee that it will be fault-free.

We do not accept liability (except as set out below) for any errors and omissions in the presentation of goods on the web site and reserves the right to change information, specifications and descriptions of listed goods and products at any time. We will, however, do our best to correct any errors and omissions as quickly as practicable after being notified of them.

We do not make any warranty that the web site is free from infection by viruses or anything else that has contaminating or destructive properties.

There are certain liabilities which cannot be excluded by law and nothing in these terms and conditions limits our liability for these, including for personal injury or death caused by our negligence or for fraud. Also, nothing in these terms of conditions limits your statutory rights if you are contracting with us as a consumer, including your right to a replacement or repair where products supplied are not of satisfactory quality.

In any event, we are not liable for: (1) any losses, howsoever arising, related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption; or (2) any special or indirect loss or damage, howsoever arising, unless that loss or damage is foreseeable to both of us at the time we entered into a contract.

§ 11 Intellectual property

All of the content you see and hear on the website, including, for example, all of the page headers, images, illustrations, graphics, audio clips, video clips, and text are subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by us, one of our partners or by third parties who have licensed their materials to us.

This website is for personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information obtained from this website. You may only download to your personal computer for viewing purposes and print out a number of pages of this web site for your personal use.

§ 12 Applicable law

In all legal matters Austrian law, excluding any of its reference provisions and the UN sales law, applies exclusively to all legal dealings between aljaslemensek.com and the customer applies, in as far as this is legally permissible.

§ 13 Changes

We may at any time revise these terms by updating this posting. Since you are bound by these terms, you should therefore visit this page every so often. Please read our privacy policy carefully, as it informs you on the major aspects of the data processing on our web site and is integral part of our terms and conditions.
